SCOTUS Throws Trump a Lifeline

The New York Times among everyone else in the universe is reporting that the U.S. Supreme Court has granted certiorari in Special Council Jack Smith’s January 6th case. In that case, a unanimous three-judge panel of the U.S. Court of Appeals for the District of Columbia Circuit concluded that Trump’s argument that he is immune from prosecution for illegal acts committed while he was President was preposterous. Trumps lawyers, whose endgame has always been to delay any trial until after the 2024 election after which a re-elected Trump can instruct the Justice Department to drop the case, filed an emergency application to the Supreme Court to issue a ruling. By granting cert. SCOTUS has agreed to hear the case which gives Trump exactly what he wanted: a huge delay in the case which was slated to begin in March. The Supreme Court has scheduled arguments for April and could take months to issue an opinion. At that point, the Presidential campaign will be in full swing and regardless of the decision (most legal scholars believe SCOTUS will uphold the Court of Appeals ruling), a judge will likely postpone the trial until after the election on the grounds that it could be prejudicial.

No need to worry though. I’m sure Clarence Thomas, whose wife Ginny was deeply involved in the plot to overturn the 2020 election, will not only work to expedite the opinion but ultimately recuse himself, given his high ethical standards.
